1. Acceptance of Terms
By accessing or using Find Innovative Trainers ("F.I.T."), you agree to be bound by these Terms of Service and Liability Waiver ("Terms"). If you do not agree, you may not use F.I.T.
2. Nature of F.I.T.
F.I.T. is a curated online marketplace that connects clients with independent fitness professionals ("Trainers").
- F.I.T. does not itself provide fitness services.
- F.I.T. is not a gym, trainer, or healthcare provider.
- All services are provided solely by independent Trainers.
3. Independent Contractorsi
All Trainers are independent contractors, not employees, agents, or representatives of Find Innovative Trainers.
F.I.T.:
- Does not control how Trainers perform services
- Does not supervise sessions
- Is not responsible for Trainer conduct
4. Trainer Credentials and Certificationsi
Trainer credentials, certifications, experience, and qualifications:
- Are self-reported by Trainers
- May include documentation uploaded by Trainers
- Are not independently verified by Find Innovative Trainers
An "Approved" badge or designation on F.I.T. indicates only that a Trainer has completed F.I.T.'s onboarding review process — it does not constitute a fitness certification, endorsement, or independent verification of any credential or claim.
Clients are solely responsible for:
- Evaluating Trainer qualifications
- Verifying certifications directly with issuing organizations if desired
5. No Medical or Fitness Advicei
F.I.T. does not provide medical, health, or fitness advice.
You acknowledge that:
- Fitness activities carry inherent risks
- You should consult a qualified physician before beginning any program
6. Assumption of Riski
You acknowledge and agree that:
- Participation in fitness activities involves inherent risks, including injury, illness, or death
- You voluntarily assume all risks associated with training sessions, exercise programs, and interaction with Trainers (assumption of risk)
7. Release of Liabilityi
To the fullest extent permitted by law, you release and discharge Find Innovative Trainers, its founders, officers, employees, contractors, and affiliates from any and all claims, liabilities, damages, or losses arising out of or related to:
- Injuries sustained during training sessions
- Acts or omissions of Trainers
- Your use of F.I.T.
This includes claims based on negligence.
8. User Conduct
Clients agree:
- To provide accurate health and profile information
- To use Trainers at their own discretion and risk
Trainers agree:
- To provide accurate credentials and information
- To conduct themselves professionally and lawfully
All users agree to:
- Communicate respectfully
- Not misuse F.I.T.
9. Disputes Between Users
F.I.T. is not responsible for disputes between Clients and Trainers.
- F.I.T. has no obligation to mediate disputes
- Any disputes are solely between the involved parties
10. Payments
F.I.T. does not process payments between Clients and Trainers.
- F.I.T. is not a party to any transaction between users
- F.I.T. does not guarantee services, pricing, or outcomes
- F.I.T. is not responsible for payment disputes, refunds, or non-performance
11. Indemnification
You agree to indemnify and hold harmless Find Innovative Trainers, its founders, officers, employees, contractors, and affiliates from any claims, damages, losses, or expenses arising out of:
- Your use of F.I.T.
- Your interactions with other users
- Your violation of these Terms
12. Disclaimer of Warranties
F.I.T. is provided "as is" and "as available."
Find Innovative Trainers makes no warranties regarding:
- Safety of Trainers
- Accuracy of profiles
- Availability of services
- Fitness outcomes
13. Limitation of Liability
To the fullest extent permitted by law:
Find Innovative Trainers shall not be liable for any:
- Indirect
- Incidental
- Special
- Consequential damages
Total liability shall not exceed $100 or the amount paid to Find Innovative Trainers (whichever is greater).
14. Termination
F.I.T. may suspend or terminate access at any time, for any reason, without notice.
15. Arbitration Agreementi
Any dispute arising from these Terms shall be resolved by:
- Binding arbitration
- Conducted in the State of Texas
- Under applicable arbitration rules
You waive the right to:
- Jury trial
- Class action participation
16. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
17. Acknowledgment
By using F.I.T., you acknowledge that you:
- Understand Trainers are independent contractors
- Understand credentials are self-reported and not independently verified by Find Innovative Trainers
- Accept all risks associated with fitness activities (assumption of risk)
Acceptance is required to continue using F.I.T.
